Who can give ILA in Queensland
Independent legal advice in Queensland must be given by an Australian legal practitioner with a current practising certificate, regulated by the Queensland Law Society. Solicitors admitted in another Australian jurisdiction and entitled to practise in Queensland can also issue certificates on Queensland transactions.
Unlike NSW and VIC, Queensland does not have a separate licensed-conveyancer profession. Conveyancing in Queensland is generally performed by solicitors. That removes some confusion, but it doesn't change the rule that ILA must come from a solicitor who is independent of the transaction — not the one doing the conveyance for the borrower.
What the certificate looks like in Queensland
The form of the certificate is set by the lender, but its content is standardised. A Queensland ILA certificate will typically confirm:
- The solicitor is admitted to practise in Australia and holds a current Queensland practising certificate (or reciprocal authority).
- The solicitor is independent of the lender, broker and other parties to the transaction.
- The client attended a meeting in person or by audio-visual link.
- Identity was verified using approved photo identification.
- The legal effect of the document was explained and the client signed voluntarily.
Witnessing rules in Queensland
Queensland enabled remote witnessing during the COVID period and has since extended and refined those rules through the Justice Legislation (COVID-19 Emergency Response — Permanency) Amendment Act 2022. A Queensland solicitor can witness a signature by audio-visual link provided they:
- See the signatory sign in real time.
- Are satisfied as to the signatory's identity.
- Are reasonably satisfied the document signed and the document witnessed are the same.
- Sign either the same document or a counterpart, and annotate the witnessing clause appropriately.
The result, from the client's perspective, is the same as NSW and VIC — the appointment runs by video, the documents are wet-signed, and the originals are couriered back the same day.
Titles Queensland and registration
Mortgage registration in Queensland is handled by Titles Queensland, the state's land registry. As elsewhere in the country, mortgages are lodged electronically by the lender's settlement agent. The borrower or guarantor doesn't deal directly with Titles Queensland — you sign the paper documents, they get scanned and lodged.
Queensland has historically been quicker to adopt electronic execution for some document types, but mortgages and guarantees still typically need wet ink for the witnessed signing. Your ILA solicitor will manage the format requirements.
Common Queensland scenarios that trigger ILA
Queensland sees a particular mix of scenarios driven by interstate migration and a strong investor market:
- Interstate investors buying Queensland property, often through family trusts or SMSFs, with personal guarantees from interstate directors and members.
- Southeast Queensland first home buyers using family guarantees, particularly around Brisbane, the Gold Coast and Sunshine Coast.
- Mixed-use and rural property purchases in regional Queensland, where the bank's credit assessment often results in additional personal guarantees.
- Mining-sector small-business lending in regional centres, secured against residential property with director guarantees.
- Refinances of pre-2020 family-guarantee loans being restructured into newer products.
Timing and turnaround
Queensland contracts run on shorter settlement periods than NSW or VIC — 30 days from contract is standard, and 14-day settlements are not unusual. That compresses the ILA timeline. If you're on a 14-day contract, book ILA in the first week, not the second.
Same-day ILA is widely available in Queensland and is often the only viable option for tight contract periods. Online providers can run the appointment, return the certificate, and have wet-signed originals on their way back to the bank within hours of the meeting.
